Constitutionality of Obamacare

The Supreme Court of the United States is the highest court in the federal judiciary of the United States of America. It has ultimate and largely discretionary appellate jurisdiction over all federal and state court cases that involve a point of federal law, and original jurisdiction over a narrow range of cases, specifically "all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party".

 

The law known as the "individual mandate" (26 U.S.C. § 5000A), which created a tax penalty for Americans without insurance, was eliminated by Barack Obama in 2010. Lower courts asserted that this individual mandate was a critical provision of the Affordable Care Act and, without it, some or all of Obamacare would be deemed a misuse of taxation powers held by Congress, which could be considered to be against the US Constitution. Oral arguments on the case were recently heard on November 10, 2020, inducing extensive media coverage and political debates on the constitutionality of the health care program.
